HoloGold End User License Agreement (EULA)

Effective Date: December 18, 2025

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and Different Gold Technology LLC, a California limited liability company (“Company,” “we,” or “us”), governing your use of the software product known as HoloGold – Holographic Gaze-Oriented Live Display, including all related components, updates, documentation, and accompanying materials (the “Software”).

By installing, copying, or using the Software, or by clicking “I Agree,” you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Software.

1. License Grant

Subject to your compliance with this Agreement and payment of applicable fees, Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software solely for your personal or internal business purposes.

This license does not convey any ownership rights in the Software.

2. License Restrictions

You may not, and may not permit others to:

Copy, distribute, sell, lease, rent, sublicense, or transfer the Software

Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or underlying ideas of the Software, except where expressly permitted by law

Modify, adapt, translate, or create derivative works based on the Software

Remove or alter any proprietary notices, trademarks, or copyright markings

Use the Software to develop or assist in developing a competing product

Circumvent or attempt to circumvent licensing, activation, or technical protection mechanisms

3. Ownership

The Software is licensed, not sold.

All right, title, and interest in and to the Software, including all intellectual property rights (including but not limited to copyrights, trade secrets, and trademarks), are and shall remain the exclusive property of Different Gold Technology LLC.

4. Updates and Changes

Company may, at its discretion, provide updates, patches, or new versions of the Software. Any such updates are governed by this Agreement unless accompanied by a new license agreement.

Company reserves the right to modify or discontinue the Software at any time.

5. License Verification and Activation (optional but recommended)

The Software may include license verification, activation, or usage-tracking mechanisms to enforce licensing terms. You agree that Company may use such mechanisms to verify lawful use of the Software.

6. Termination

This Agreement is effective until terminated.

Company may terminate this Agreement immediately if you breach any provision of this Agreement. Upon termination, you must cease all use of the Software and delete all copies in your possession.

Sections concerning ownership, disclaimers, limitation of liability, and governing law shall survive termination.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

Company does not warrant that the Software will be error-free, uninterrupted, or meet your requirements.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL COMPANY’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE, IF ANY.

9. Indemnification

You agree to indemnify, defend, and hold harmless Company from any claims, liabilities, damages, losses, or expenses arising out of your use of the Software or violation of this Agreement.

10. Export Compliance

You agree to comply with all applicable export control laws and regulations. You represent that you are not located in a country subject to U.S. government embargo and are not prohibited from receiving the Software under applicable law.

11. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

Any legal action arising under this Agreement shall be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

12. Entire Agreement

This Agreement constitutes the entire agreement between you and Company regarding the Software and supersedes all prior or contemporaneous understandings, agreements, or representations.

If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.

Different Gold Technology LLC (“Company,” “we,” or “us”) respects your privacy. This Privacy Policy explains how we handle information in connection with the HoloGold – Holographic Gaze-Oriented Live Display software (“HoloGold” or the “Software”).

1. Overview

HoloGold is a desktop application that performs all core functionality locally on your device. We do not operate user accounts, host user content, or collect usage analytics from within the Software.

Name (if provided)

License or order details

Payment information is processed by our payment provider (e.g., Lemon Squeezy) and is not stored or processed by us.

We do not collect:

Usage analytics

Behavioral tracking data

Advertising identifiers

User-generated content

Webcam images or video

Facial data, gaze data, or biometric identifiers

Keystrokes, screen recordings, or audio

3. Webcam and Eye-Tracking

HoloGold uses your computer’s webcam to enable real-time, on-device eye-tracking for holographic visualization effects.

Webcam images are processed locally on your device in real time

Images and eye-tracking data are not recorded, stored, transmitted, or shared

All eye-tracking computation occurs entirely on your local machine

Different Gold Technology LLC does not receive, store, or transmit webcam images, gaze data, or biometric information.

4. How We Use Information

Any information we receive is used solely to:

Deliver licenses and software access

Provide customer support

Respond to inquiries

Comply with legal obligations

We do not sell or rent personal information.

5. Third-Party Services

We may rely on third-party service providers for:

Payment processing

License delivery

Email communication

These providers process information under their own privacy policies. We encourage you to review those policies directly.

6. Data Security

We take reasonable measures to protect the limited information we handle. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Children’s Privacy

HoloGold is not intended for use by children under the age of 13. We do not knowingly collect personal information from children.

8. International Users

HoloGold may be used worldwide. By using the Software, you understand that information may be processed in the United States or other jurisdictions where our service providers operate.

9. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date and make the revised policy available through the Software or our website.
